Albany Update

Budget Update
After passing the budget last week, the Legislature continues to negotiate with Governor Pataki over possible changes to that budget in order to avoid the possibility of vetoes. Governor Pataki has until midnight, Tuesday, April 12th to veto provisions of the budget to which he objects.

The Governor has provided the Legislature with lists of changes that he wants made to the budget, including both minor, “technical” changes and major outstanding policy issues. If agreement can be reached on issues that the Governor has raised, the Legislature would pass “chapter” amendments, separate bill that would amend the budget bills already passed and sent to the Governor’s desk. Outstanding issues include: how to spend federal Temporary Assistance for Needy Families (TANF) funds; a variety of programs funding capital projects, including SUNY and CUNY programs; the Environmental Protection Fund; video lottery terminals (VLTs) and conversions of not-for-profit health insurance plans.

The Governor has also proposed a number of more minor, “technical” changes in a variety of issue areas. The legislative leaders have told the Governor that they want any legislation enacting these chapter amendments to be in print in the full three days before passage. Meeting this deadline will require agreements to be made and bills printed by midnight tonight (Friday, April 8th).

If agreement cannot be reached on all of these issues, the following scenarios would be possible: no vetoes, with negotiations continuing into the remaining session; vetoes with legislative overrides; vetoes with negotiations over overrides and outstanding issues continuing into the remaining session. There is no limitation on the time the Legislature has to override the Governor’s vetoes.
